The 2018 Law on National Security, passed by the 14th National Assembly on June 8, 2018 to replace the 2005 one, has come into effect since January 1, 2019 and replaced the 2005 one. The 2018 law, which has been revised on the basis of the Politburo's instructions and the 2013 Constitution, has overcome the shortcomings of the 2005 law while ensuring the consistency and uniformity of the system of legal documents of the State and meeting the requirements of the current situation and tasks of national defense, national security and the Fatherland protection, as well as maintenance of social order and safety, crimes control, and building of the armed forces in the new period.
The 2018 National Defense Law has several supplements and amendments related to the armed forces, such as components of the armed forces, the use of armed forces, martial law, curfew, national mobilization; civil defense, national defense and security education, defense and security industry.
Some new contents of the 2018 Law on National Defense involves the Public Security Forces. For instance, Article 17 of the 2005 Law was named “The Public Security Forces in performing national defense missions”, but the 2018 defines the forces’ mission in Article 26 named “Public Security Forces”.
Speaking at the event, Deputy Minister Le Quy Vuong underlined the importance of the 2018 National Defense Law to the Public Security Forces as it is directly related to the contents of many laws and ordinances in the field of public security, safety and order, namely: The National Security Law, Law on Public Security Force, Law on foreigners' entry into, exit from, transit through and residence in Vietnam... The Deputy Minister also requested all public security agencies and units to review guiding documents on the implementation of the 2018 Law on National Defense to propose appropriate amendments and supplements as well as removal of legal documents that are not consistent with or suitable for the 2018 Law on National Defense.
