Based on the practical situation, the NA Committee on National Defense and Security proposes to apply suspension of overseas exit to the following cases: “A person is under introgation by inspection bodies, which have sufficient proofs of the person’s especially serious wrongdoings, and consider taking measures to necessarily and immediately prevent her or him from fleeing;” and “A legal representative of an agency or organization that has to serve a judgment or decision made by the court”. For a person who is involved in a case under investigation has clear demonstrations of offences, the Investigation Agency shall issue a decision to prosecute the person, and he/she will be suspended from exiting the country as prescribed in Clause 1 of this Article.
Speaking on behalf of the drafting board of the law project, Senior Lieutenant General Le Quy Vuong, member of the Party Central Committee and Deputy Minister of Public Security agreed that cases of exit suspension should be scrutinized. Deputy Minister Vuong explained that cases of temporary suspension of overseas exit are not specific causing difficulties for agencies in the implementation.
He also noted that suspension of overseas exit also compromises human and civil rights so it must be considered carefully, except for cases with decisions of prosecuting bodies.
The Vice NA Chairman asked the Committee on National Defense and Security to coordinate with relevant agencies to collect opinions of the NA Standing Committee to complete the draft law and submit to the NA at the 8th session.
