MPS holds consultation on draft Law on Organization of Criminal Investigation Agencies (amended)

Member of the Party Central Committee and Deputy Minister of Public Security Senior Lieutenant General Le Van Tuyen chaired the conference.

Speaking at the consultation, Director of the Department of Legal Affairs and Administrative–Judicial Reforms under the MPS Lieutenant General Pham Cong Nguyen stated that, on the basis of the Party’s guidelines and policies on streamlining and restructuring the political system to ensure effectiveness and efficiency, relevant legal documents, the summarization of the implementation of the 2015 Law on Organization of Criminal Investigation Agencies as well as international treaties and commitments to which Vietnam is a party, the Ministry of Public Security had developed three major policy groups for the draft amended law.

The relevant policy groups focus on strengthening the organizational model of criminal investigation agencies, refining provisions on investigative jurisdiction and improving regulations concerning the names, organizational structures, functions, duties, powers and investigative authority of agencies assigned to conduct certain investigative activities.

At the session, delegates generally expressed their agreement with the draft Law on Organization of Criminal Investigation Agencies (amended).

Participants also contributed opinions on improving the quality and capacity of grassroots-level investigators, while emphasizing the need to further clarify coordination mechanisms and the division of responsibilities between communal police stations and provincial-level criminal investigation agencies in conducting investigative activities.

Concluding the consultation session, Deputy Minister Le Van Tuyen requested the drafting agency to fully take note of opinions and recommendations given by delegates in order to further refine the dossier of the draft law.

The Deputy Minister emphasized the need to ensure consistency among policy groups, legal grounds, implementation contents and proposed solutions, while crafting orientations for amendments and conducting comprehensive impact assessments for each policy. He also stressed the importance of avoiding overlap and ensuring full compliance with procedures for developing policy dossiers.

In addition, Deputy Minister Le Van Tuyen requested the drafting agency to further clarify issues related to the division of authority, coordination mechanisms and responsibilities of relevant agencies during implementation.

He called on ministries, sectors, localities and committees of the National Assembly to continue closely coordinating with the Ministry of Public Security throughout the drafting and appraisal process, thereby ensuring broad consensus and unity before the draft law is submitted to competent authorities for consideration.
