MPS evaluates implementation of 2015 Penal Code

The Ministry of Public Security (MPS) held a conference on the review of the implementation of the 2015 Penal Code (amended and supplemented in 2017 and 2025), on the morning of March 20, in Hanoi.

According to reports presented at the event, the effective enforcement of the Penal Code has contributed to a notable improvement in criminal investigation and prosecution, helping exactly identify offenders and offenses in accordance with the law, thereby contributing to curbing crime and maintaining political stability, social order and safety.

However, after more than eight years of the implementation of the law, several shortcomings and challenges have been seen. 

The 2015 Penal Code has yet to fully address certain newly emerging dangerous acts in practice, while some provisions have not been updated to reflect the Party’s policies nor to include contents of international treaties to which Vietnam is a party.

Given these issues, the Penal Code is necessary to be amended and supplemented in the coming period so as to meet legal requirements in the reality, contributing to strengthening the legal framework for crime prevention and control, safeguarding national security and ensuring social order and safety. 

The revision process is expected to be conducted in a comprehensive, consistent, transparent and accessible manner to meet the domestic standards as well as international standards.

At the meeting, delegates discussed issues regarding the implementation of the law, identified difficulties and inadequacies, and gave recommendations and solutions to improve the Penal Code.

In his concluding remarks, Deputy Minister Le Van Tuyen emphasized that amending and supplementing the 2015 Penal Code is necessary to reinforce the legal foundation for combating crime, protecting fundamental human rights and safeguarding the legitimate rights and interests of organizations and individuals.

Regarding the policy for the revision of the law in the coming time, the Deputy Minister requested relevant agencies, ministries, sectors and public security units to update and concretize the Party’s guidelines and the State’s policies on crime prevention and control in the new context, particularly newly issued resolutions of the Politburo.

On that basis, he assigned the Department of Legal Affairs and Administrative - Judicial Reforms to take the lead in researching and proposing amendments to the Penal Code, ensuring the quality of the draft and the timeline.

He also called on ministries, sectors and judicial agencies to coordinate closely with the drafting group of the Ministry of Public Security and provide it with ideas and suggestions, enabling the drafting group to promptly complete the revision of the law.
