Vietnamese authority officially announces Nguyen Dinh Thang’s involvement in terrorism

On the basis of the Vietnamese laws and international law, the Ministry of Public Security determined that the below-listed individual has been or is being involved in terrorism.

2. Terrorism-related activities

Nguyen Dinh Thang is the leader and acts as executive director of the organization “Boat People SOS" (BPSOS), who has close ties with the "Montagnards Stand for Justice” (MSFJ) organization, which carried out the terrorist attacks on June 11th, 2023, in Dak Lak province, Vietnam.

On March 6th, 2024, the Ministry of Public Security of Vietnam made an official announcement on its Web Portal that MSFJ was officially listed as a terrorist group and its members, accordingly, were terrorists.

As the leader of the terrorism-related organization BPSOS, Nguyen Dinh Thang directed BPSOS members to support and directly participated in numerous activities in support of the terrorist organization MSFJ.

(1) Nguyen Dinh Thang’s involvement before the Ministry of Public Security listed MSFJ as a terrorist organization:

Nguyen Dinh Thang directed BPSOS members, including Truong Minh Tam, Tran Khanh Trang, to support Y Quynh Bdap, Y Phik Hdok, Y Pher Hdrue, Y Aron Êban, H’ Sarina Krong, H’ Tlun Bdap, Y Ruing Knul, and H Mla Hdruẽ (having listed as terrorists by the Ministry of Public Security) in establishing the MSFJ organization in July 2019 in Thailand, and registering as a legal entity in Virginia, USA so that it could legally operate in the country from April 2023.

To support MSFJ's operations, Nguyen Dinh Thang directly provided guidance, financial support, and other resources, as well as paid salaries to MSFJ members carrying out acts of sabotage against Vietnam, including their terrorist acts on June 11, 2023, in Dak Lak province, Vietnam.

(2) Nguyen Dinh Thang’s activities after the Ministry of Public Security officially named MSFJ as a terrorist organization:

After the Dak Lak Provincial Police Department’s Security Investigation Agency issued Wanted Decision No. 12/QDTN-ANDT on August 14th, 2023, accusing Y Quynh Bdap, one of the masterminds of the June 11th, 2023 terrorist attacks in Dak Lak, and the Ministry of Public Security officially listed MSFJ as a terrorist organization, Nguyen Dinh Thang continued to provide financial assistance, guidance and operational direction to MSFJ members, including Y Quynh Bdap and Y Phik Hdok.

Nguyen Dinh Thang also gave financial aid and arranged accommodation for Y Quynh Bdap to evade capture in Thailand.

After Y Quynh Bdap was arrested and faced legal proceedings in Thailand, Nguyen Dinh Thang actively sought ways to prevent the Thai court from issuing a ruling to send Y Quynh Bdap back to Vietnam, and fundraised to finance Thai lawyers to defend Y Quynh Bdap in court.

In coordination with H’Biap Krong, a member of the MSFJ terrorist organization, Nguyen Dinh Thang tried hard to lobby international organizations to support MSFJ and its terror operation.

All organizations and individuals shall be required to freeze, seal and sequester without delay funds and other assets of terrorists or/and  terrorism financers that have been listed by the United Nations Security Council or/and the Vietnamese Government on the Web Portal of the Ministry of Public Security of Vietnam, and to report without delay the case to the counter-terrorism force of Vietnam’s Ministry of Public Security (Department of Homeland Security under Ministry of Public Security; Address: No. 15 Tran Binh Trong St., Hoan Kiem District, Hanoi; Phone number: 0692341269; email: groupckbqt@gmail.com).

II. Procedures for handling complaints from organizations and individuals regarding the inclusion in or removal from the list of organizations and individuals related to terrorism and terrorism financing:

1. In Vietnam:

* Officer representing the Vietnam’s competent agency is responsible for guiding individuals and organizations to lodge complaints about their being on the terrorist list publicized on the Web Portal of the Ministry of Public Security:

* Procedures for handling complaints from organizations and individuals whose assets are suspended from circulation, frozen, sealed, sequestrated or handled due to their links with terrorism or terrorist financing, or who are listed as related to terrorism/terrorist financing shall be carried out in accordance with the 2018 Law on Denunciations; the 2021 Law on Complaints; Decree No. 93/2024/ND-CP dated July 18, 2024 (amending Decree No. 122/2013/ND-CP); Decree No. 22/2019/ND-CP dated February 25, 2019 on denunciation procedures in the People's Public Security Forces; Circular No. 85/2020/TT-BCA dated August 3, 2020 on receiving, classifying and handling denunciations within the People's Public Security Forces; Circular No. 129/2020/TT-BCA dated December 8, 2020 detailing and guiding the implementation of a number of articles of Circular No. 85/2020/TT-BCA issued on August 3, 2020 by the Ministry of Public Security on receiving, classifying and handling denunciations in the People's Public Security Forces; Circular No. 23/2022/TT-BCA dated May 16, 2022 stipulating the authority, order and procedures for settlement of complaints in the People's Public Security Forces and other relevant legal documents.

* Organizations and individuals may initiate lawsuits against decisions on suspension of circulation, freezing, sealing, sequestration and handling of money and assets related to terrorism and terrorism financing, inclusion in or removal from the list of organizations and individuals related to terrorism and terrorism financing in accordance with Article 117 of the 2015 Law on Administrative Procedures (amended and supplemented in 2019 by the Law amending and supplementing a number of articles of the Law on State Audit) of the Socialist Republic of Vietnam as follows:

“1. When instituting an administrative lawsuit, the claimant shall make a lawsuit petition in accordance with Article 118 of the Law.

2. Individuals with the full administrative procedure act capacity may make lawsuit petitions by themselves or ask others to do so for them. The items of the plaintiff’s name and address in a petition shall be filled with the individual’s full name and address. The individual shall give his/her signature or press his/her fingerprint on the bottom of the petition.

3. Lawful representatives of individuals who are minors, have lost their civil act capacity, have their civil act capacity restricted or meet difficulties in cognizing or controlling their acts may make lawsuit petitions by themselves or ask others to do so. The items of the plaintiff’s name and address in a petition shall be filled with the full name and address of the lawful representative of the claimant. The lawful representative shall give his/her signature or press his/her fingerprint on the bottom of the petition.

4. Individuals falling in the cases specified in Clauses 2 and 3 of this Article who are illiterate, have vision disability or are unable to make lawsuit petitions by themselves and to give their signatures or press their fingerprints on petitions may ask others with the full administrative procedure act capacity to make lawsuit petitions, and they shall be the witness of the claimant and give signatures on these petitions.".
