Presidential Decision on 2025 Amnesty (Phase 2) released

MPS - The Presidential Office, in coordination with the Ministry of Public Security, the Ministry of Foreign Affairs, the Supreme People's Court and other relevant agencies, held a press conference on July 7 to announce Decision No. 1244/2025/QD-CTN on the 2025 Amnesty (Phase 2) signed by the President of the Socialist Republic of Vietnam. During the press conference, Deputy Head of the Presidential Office Pham Thanh Ha announced Decision No. 1244/2025/QD-CTN on the 2025 Amnesty (Phase 2), which aims to grant early release from prison to inmates sentenced to fixed-term imprisonment or life imprisonment, on the occasion of the 80th National Day of the Socialist Republic of Vietnam (September 2, 2025). Specifically, the amnesty applies to:

•    Inmates currently serving fixed-term prison sentences.
•    Inmates sentenced to life imprisonment whose sentences have been commuted to fixed-term imprisonment.
•    Individuals currently on temporary suspension of their prison sentences.

The decision also clearly outlines the conditions for proposed amnesty, cases not eligible for proposed amnesty and amnesty possibly applied to special circumstances.

Responding to a reporter's question about whether this is the first time two amnesty decisions have been executed in one year, Deputy Minister Le Van Tuyen, on behalf of the Ministry of Public Security (the standing agency of the Amnesty Advisory Council), clarified that amnesty is a special clemency policy of the State, decided by the President to grant early release to inmates sentenced to fixed-term or life imprisonment during major national events, grand holidays, or other special cases. He stated that there have been two amnesty phases in a single year, citing 2009 and 2011 when two phases of amnesty also executed.
